Normas Internacionais e Observações Gerais de Proteção à Mulher Gestante violadas pela Reforma Trabalhista

Abstract

O presente trabalho analisa o artigo 394-A da CLT, alterado pela Reforma Trabalhista oriunda da Lei 13.467/2017, à luz de diplomas internacionais promulgados pelo Brasil e suas Observações Gerais, em específico o Pacto Internacional dos Direitos Econômicos, Sociais e Culturais (PIDESC) e a Convenção sobre a Eliminação de todas as Formas de Discriminação contra a Mulher (CEDAW), bem como as Observações Gerais nº 22 do Comitê de Direitos Econômicos, Sociais e Culturais (OG22-CDESC) e nº 24 do Comitê sobre a Eliminação de todas as Formas de Discriminação contra a Mulher (OG24-CEDAW). Utilizou-se o método hipotético-dedutivo para responder: a alteração legislativa sob análise infringiu disposições do PIDESC e CEDAW e das OG22-CDESC e OG24-CEDAW, respectivamente? Ao final a resposta foi positiva e a tese validada, comprovando-se que a reforma trabalhista infringe dispositivos dos diplomas internacionais ora analisados.

This paper analyzes article 394-A of the CLT, modified by the Labor Reform of Law 13467/17, in light of international diplomas enacted by Brazil and its General Observations, specifically the International Covenant on Economic, Social and Cultural Rights (ICESCR) ) and the Convention on the Elimination of All Forms of Discrimination against Women (CEDAW), as well as General Comment No. 22 of the Committee on Economic, Social and Cultural Rights (OG22-CDESC) and No. 24 of the Committee on the Elimination of all Forms of Discrimination against Women (OG24-CEDAW). Was the hypothetical-deductive method used to answer: the legislative amendment under review violated provisions of the ICESCR and CEDAW and OG22-CDESC and OG24-CEDAW respectively? In the end the answer was positive and the thesis validated, proving that the labor reform violates provisions of the international diploma analyzed here.  Keywords: Labor reform; Legislative amendment; International diploma; PIDESC; CEDAW
