A Simplificação e Desburocratização da Segurança e Saúde no Trabalho Introduzidas pela Norma Regulamentadora NR-01

Abstract

O estudo tem por finalidade analisar os principais aspectos da Portaria nº. 915, de 30 de julho de 2019, que aprovou a redação da Norma Regulamentadora n. 01 e disciplina as disposições gerais da segurança e saúde no trabalho. Trata-se de uma investigação de natureza descritiva e propositiva que visa explicitar as inovações dessa norma que, a partir de disposições gerais, serve como base das demais normas regulamentadoras. Para a coleta, utiliza-se da pesquisa bibliográfica e documental. A discussão diz respeito à sua efetivação em meio ao ordenamento já existente. A conclusão que se tem é que a norma em estudo diminui a burocracia e a intervenção estatal na iniciativa privada, embora persistam algumas incertezas futuras quanto a segurança jurídica de empregados e empregadores.

The Simplification and without Bureaucracy Safety and Health at Work Introduced by Regulatory Standard NR-01

Abstract: The purpose of the study is to analyze the main aspects of Ordinance no. 915, of July 30, 2019, which approved the wording of Regulatory Standard no. 01 and disciplines the general provisions of occupational safety and health. This is a descriptive and purposeful research that aims to clarify the innovations of this standard that, based on general provisions, serves as the basis of other regulatory standards. For the collection, the bibliographic and documentary research is used. The discussion concerns its implementation in the midst of the existing order. The conclusion is that the standard under study reduces bureaucracy and state intervention in private enterprise, although some future uncertainties regarding the legal certainty of employees and employers persist.
